Terms and Conditions of Sale

1. Acceptance of Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") govern the sale of jewelry, pearls and accessories between Mihiarii Pearls and you, the consumer.

Before making an order at our site, you must fully accept the Terms.

Mihiarii Pearls reserves the right, at any time and without notice, to change these Terms. Consequently, we encourage you to read the Terms before each order.

2. Online store

Our online store provides the products we are selling on the Internet. We try to describe as accurately as possible jewelry, pearls and accessories we sell. Nevertheless, because of the special nature of the tahitian pearls, some data are subjective (dependent on the discretion of the observer). These data include the color, the brightness, and so on, of the pearls. Moreover, these characteristics are subject to variation, for example depending on the type of light and the brightness of the place where the pearls are observed. Therefore, these data do not give any guarantee and Mihiarii Pearls can not be held responsible for a description that the consumer feels inaccurate.

We also try to associate each product with an accurate picture. We make no adjustements to improve the appearance of the product, except some changes in brightness or contrast. Nevertheless, for the reasons outlined in the previous paragraph, these photographs have no contractual value. (For your information, most of our photos are taken in a lightbox equipped with LED daylight tube of high intensity).

The prices are all taxes included (TTC). They include applicable taxes in French Polynesia.

The prices can be displayed in three currencies : pacific francs, euros or dollars. We try to update the conversion rates as often as possible, but conversion are give «as is» The reference prices are pacific francs and euros. Please note that, when using pacific francs with HiPay payment method, the price will be automatically converted in euros, as pacific francs are not available on HiPay.

3. Orders

Subsequently, by going to your shopping cart, you can view a summary of the order and an assessment of various fees. The shipping costs shown in this step are the maximum fees, if you are not connected to your user account. It is then necessary to validate the order to take the next steps.

To make an order, it is not required to create or connect to your user account. However, the requested information (address, phone number and so on) need to be accurate and up to date. Otherwise Mihiarii Pearls can not be held responsible for any delivery errors. Additional costs would be at the expense of the consumer.

You will then be asked to choose a method of delivery that are available for your location.

Finally, you can choose a payment method from the available methods. Your payment and order validation serves as electronic signature.

4. Payment


We currently offer two methods of payment:
• HiPay, a secure method that allows you to pay either directly with your HiPay account or with your credit or debit card. Your order will be confirmed upon receipt of confirmation of payment by the HiPay services. On payment, you will be redirected on HiPay website. Mihiarii Pearls do not have access and do not store your credit card numbers.
• Bank transfer, a deferred payment method. Your order will be confirmed upon receipt of your payment to our bank account. Bank Transfers can take days to reach the recipient's bank account. Please include your order number in the wording of the transfer.


Under French legislation, the consumer have 70 days to contest the payment, especially in case of fraudulent use of the means of payment. In this case, the consumer must immediately contact Mihiarii Pearls through the online contact form or by email. The consumer will be refunded without additional fees within one month from the receipt of such contestation.


In case of refusal of authorization of payment by banking services, Mihiarii Pearls reserves the right to suspend or cancel the order.

5. Delivery


If you live or if you go to French Polynesia and have the opportunity to go to one of our stores, you can choose pick up in-store option. This delivery method is free.

In other cases, the packages will be sent through the Office of Post and Telecommunications (OPT) of French Polynesia. Given the nature of our products, we are asked special packaging resulting in additional cost to the consumer. But, at this time, no other carrier accepts to transport jewelry with pearls. Nevertheless, the advantage of this method is to include insurance in case of loss, damage or theft. Depending on the place of destination, the consumer may be required to pay customs fees when receiving his order. All customs fees will be at the consumer's expense. Mihiarii Pearls has no control over the customs fees. Before ordering, please inquire about customs fees applicable in your country regarding the products we sell.


If, on the arrival of your package at home, it is in poor condition, please do not accept it and give the reason in the form provided for this purpose. Your signature on the delivery order will be understood as acceptance of the package.

6. Cancellation & Refunds


Under French legislation, the consumer may exercise his right of withdrawal within 14 days from the day of receipt of the package, without justification on his part. In this case, the product will be returned to Mihiarii Pearls at the consumer's expense, in good condition and in its original packaging. The shipment will be made within 14 days following the withdrawal. We can defer the reimbursement until we receive the returned goods or until we receive a proof of sending.


Some products are not subject to withdrawal. This is the case of products specially made for the consumer.


In case of non-compliant or defective delivery, you can request repair, exchange or refund of the product concerned. The consumer has to return the goods it in its original packaging, indicating the reason for refusal on the delivery note or invoice. The return costs will be at the expense of Mihiarii Pearls.

For any withdrawal or return, please use our online form in your user space or email us before returning goods.

7. Governing Law

The seller is installed in French Polynesia in a stable and sustainable way to do business there.

Consequently, these Terms are governed by French law.

In case of disagreement or dispute, the customer should first contact the seller in order to find an amicable agreement.

If no agreement can be found, the consumer may open proceedings before the Court of Commerce in Papeete.
